These Terms of Service ("Terms") are a legal agreement between you and Lithium Arcade ("Lithium Arcade", "we", "us", or "our"), operated by Playlithium Interactive LLC, and they govern your use of the free web arcade at arcade.playlithium.com (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you are a parent or guardian using the Service and a child is present, you accept these Terms on that child's behalf and are responsible for their use of the Service.
Lithium Arcade is a free, family-friendly online arcade for a general audience. You can play a curated library of browser games instantly — there is nothing to download or install, and no account, sign-up, or login is required. The games themselves are third-party content delivered through secure embeds (see Section 4). We may add, change, or remove games and features at any time, and we may make the Service available or unavailable in particular regions.
The Service is a general-audience service. It offers family-friendly content but is not directed to children, and it is intended for users aged 16 and over. By accessing or using the Service, you represent that you are at least 16 years old, or that you are using the Service under the supervision of, and with the consent of, a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use. The interactive games are provided by our third-party games partner, GamePix, whose own terms likewise require users to be 16 or older; the games load as third-party embeds that carry advertising and tracking we do not control.
Regardless of the general 16+ eligibility above, the interactive games are not offered to any user under 13 in regions with strict children's-privacy laws, including (for example) the United States (COPPA), the EU/EEA and the United Kingdom (GDPR / the UK Children's Code), Switzerland, Brazil (LGPD), Canada, South Korea, India, Australia, China, Indonesia, and South Africa. In those regions a user who indicates they are under 13 is not permitted to play and is asked to have a parent or guardian use the Service instead; in some of these regions the Service may be paused entirely. Where local law sets a higher age of digital consent (for example 14, 15, 16, or 18), that higher local threshold governs, and a user below it should use the Service only with the involvement of a parent or legal guardian.
If you are a parent or legal guardian and you permit a younger player to use the Service, you accept these Terms on that player's behalf, you are responsible for supervising their use, and you acknowledge that the embedded third-party games display advertising (including, outside restricted regions, behavioral and targeted advertising) governed by GamePix's own Privacy & Cookie Policy, which we do not control. The games available on the Service are third-party content provided and operated by our games partner, GamePix, and are loaded within embeds (iframes). GamePix and the games' respective developers operate that content; we do not control and are not responsible for the content, functionality, availability, data practices, or any advertising of those third-party games. In particular, GamePix uses its own cookies, trackers, identifiers, and fingerprinting, and serves advertising inside the games — including behavioral and targeted advertising, which (for U.S. residents) GamePix treats as a "Sale" and "Sharing" in California. These practices are governed by GamePix's own Privacy & Cookie Policy and are outside our control; we encourage you (and parents and guardians) to review it. Your use of a third-party game may be subject to that party's own terms and privacy practices. If you have a concern about a specific game, please contact us (see Section 12) and we will look into it with the partner.

The Service does not use accounts. There is no registration, login, or password, and we do not collect direct contact details from you to use the Service. Because there is no account, any settings or recommendations are stored on your own device and can be cleared at any time (see our Privacy Policy).
The "Lithium Arcade" name, logo, branding, the Site's design, and the software and arrangements we create are owned by or licensed to us and are protected by intellectual-property and trademark laws. The individual games and their assets remain the property of their respective creators, publishers, and partners (including GamePix). Except as allowed by these Terms or applicable law, you may not copy, reproduce, distribute, modify, or create derivative works from the Service, our branding, or any game assets without permission from the rights holder.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, error-free, or available at any particular time, that any game will function correctly, or that recommendations will be accurate. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
To the maximum extent permitted by law, Lithium Arcade and its operator, affiliates, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or relating to your use of (or inability to use) the Service or any third-party game, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability for any claim relating to the Service is limited to the greater of the amount you paid us to use the Service (which, for a free service, is zero) or USD $100. Nothing in these Terms limits liability that cannot be limited under applicable law.
We may suspend, restrict, or discontinue the Service (in whole or in part), or restrict access to any feature, at any time and with or without notice — for example, for operational reasons or if we believe these Terms have been violated. You may stop using the Service at any time.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and note material changes on the Service. Your continued use of the Service after an update means you accept the revised Terms.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where applicable law gives you the right to bring a claim elsewhere.
